Getting denied for Social Security Disability benefits can feel discouraging, but you’re not alone—and more importantly, you have the right to appeal. Many people in Florida who are initially denied benefits later win their case during the appeals process. Here's how to get started and improve your chances.

Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.

Please answer a few questions to help us determine your eligibility.

Step-by-Step: Appealing a Disability Denial in Florida

Step 1: Understand Why You Were Denied

Before you appeal, carefully review the denial letter from the Social Security Administration (SSA). It will explain:

  • The reason for denial (medical, technical, or incomplete application)
  • What information was missing or insufficient
  • Your deadline to file an appeal (usually 60 days from the date on the letter)

Knowing why you were denied is critical to successfully challenging the decision.

Step 2: File a Request for Reconsideration

This is the first level of appeal. In Florida, you must request a Reconsideration within 60 days of your denial.

  • You can do this online at www.ssa.gov
  • Include any new medical evidence or corrections to your original application
  • The SSA will review your claim again, usually without a hearing

Step 3: Request a Hearing with an Administrative Law Judge (ALJ)

If your reconsideration is denied, the next step is to request a hearing before an ALJ.

  • The hearing will take place at a local SSA Office of Hearings Operations in Florida
  • You’ll present your case, submit updated records, and possibly testify
  • A judge will decide whether to overturn the denial

This is your best chance to win your appeal—especially if you’ve gathered strong medical documentation or legal support.

Step 4: Prepare Strong Medical Evidence

Winning your appeal often depends on the strength of your medical evidence. Be sure to:

  • Keep all medical appointments
  • Request detailed records and letters from your doctors
  • Submit evidence showing how your condition prevents you from working
  • Include information from specialists, if applicable

Step 5: Consider Legal Support

Although not required, many applicants in Florida choose to work with a disability attorney at this stage. An experienced legal team can help:

  • Identify weaknesses in your original application
  • Collect stronger evidence
  • Represent you at your hearing and help you prepare

Most disability attorneys only get paid if you win your case.
